Terms of Use

1. USAGE PERMISSION

The usage permission is only for registered commercial users. Furthermore, the use of the permission is bound to the intended purpose of A.T.E. (BU: HMX).  Thus, no usage of this software may be made, unless it complies with the earmarked purpose of A.T.E. (BU: HMX). For all cases of the offence, A.T.E. (BU: HMX) shall have the right to obtain any injunctive or equitable relief that it deems necessary or appropriate in addition to any other remedies it may have at law or in equity. The information, software and documentation provided by A.T.E. (BU: HMX) can be freely used for commercial purposes. A.T.E.(BU: HMX) grants Users a non-exclusive and non-transferable right to use the information, software and documentation free of charge without time restriction, limited to the extent of the purpose intended by A.T.E.(BU: HMX) in making the same available.

2. DESCRIPTION OF ADDITIONAL RIGHTS AND LIMITATIONS

Information, software and documentation may not be distributed by the User to any third party at any time nor may it be rented or in any other way made available. Unless such is allowed by mandatory law, the User shall not modify the software or documentation nor shall they disassemble, reverse engineer or decompile the software or separate any part thereof. The commercial utilization or propagation of information, software and documentation - in any form whatsoever - requires written consent by A.T.E.(BU: HMX).

3. COPYRIGHT

The ownership and copyright of the information, software and documentation (including, but not limited to any kind of pictures, photographs, animations, video, music, text, and „applets “, which are included in the software), the printed accompanying materials and all copies of the software product lie with A.T.E. (BU: HMX). The information, software and documentation are protected by copyright laws as well as international copyright treaties as well as other laws and conventions related to intellectual property. The User shall observe such laws and in particular shall not modify, conceal or remove any alphanumeric code, marks or copyright notices neither from the information nor from the software or documentation, or any copies thereof. Except for the rights of use and other rights expressly granted herein, no other rights are granted to the User nor shall any obligation be implied requiring the grant of further rights. Any and all patent rights and licenses are expressly excluded.

4. PRODUCT SUPPORT

Users have no claim to product support by A.T.E. (BU: HMX). Product support will be offered via email and telephone.

5. UPDATING

A.T.E. (BU: HMX) is not obliged to make available updates for the User. However, all updates provided by A.T.E. (BU: HMX) are covered by this license agreement.

6. LIABILITY FOR DEFECTS OF TITLE OR QUALITY / OTHER LIABILITY

Any liability for defects as to the quality or title of the information, software and documentation especially in relation to the correctness or absence of defects or the absence of claims or third-party rights or in relation to completeness and/or fitness for purpose are excluded except for cases involving wilful misconduct or fraud. Any further liability of A.T.E. (BU: HMX) is excluded unless required by law, or in cases of wilful misconduct, gross negligence, personal injury or death, failure to meet guaranteed characteristics, fraudulent concealment of a defect or in the case of breach of fundamental contractual obligations. Damages in the case of breach of fundamental contractual obligations are limited to contract-typical, foreseeable damage if there is no wilful misconduct or gross negligence. As far as legally allowed, in no event shall A.T.E. (BU: HMX) be liable for any damages whatsoever, including without limitation, damages for loss of profits, business interruption or loss of information.

7. DATA PRIVACY PROTECTION

I agree that A.T.E. (BU: HMX) is allowed to save my data for informing me about news in the future. Data is not disclosed to third parties. Additionally, the Administrators of this system can delete your account for any reason.
